SUPPORT & ACCOUNTABILITY POLICY

The practice of providing Lifestyle Management consulting is increasingly complex and challenging. For Body Refined to operate effectively and provide the best service to you and your family, Body Refined needs your cooperation with the following accountability policies. Your clear understanding of these policies is very important.
OFFICE HOURS
Office hours are Monday-Friday from 8:00 am to 5:00 pm and Saturday’s by appointment only. Clients are not scheduled from 11:30 am through 1:00 pm on Weekdays. However, the phone and patient portal remains open for messages. Body Refined is closed on Sunday’s and in observance of major holidays.
AFTER HOURS
If you are making contact after hours and it’s important for you to reach someone, leave a voice message on the answering service. Someone will receive a transcribed copy of your voice message. If time permits and depending on the nature of your call, your call will be returned as soon as possible but no later than the following morning, excluding Sunday & Holidays. As a reminder, sending a message via the patient portal after hours will not be received until the next business day.
If a telephone or video call is made after hours, a $5 fee may be charged unless you are paying the monthly after-hours fee ($25) which affords you fee-less communications after hours.
TELEPHONE & PORTAL MESSAGES
Body Refined will try their best to respond to your messages as soon as possible. However, please be aware that messages may take up to 2 hours to respond. Often, if your questions require extensive attention, Body Refined may elect to have you make an appointment for quality assurance purposes.
CHANGES IN ADDRESS, BILLING, OR CONTACT INFORMATION
Please notify Body Refined via email of any changes of address, telephone, billing or contact information. It is imperative that Body Refined has the most current information on file.
 APPOINTMENTS & NO SHOWS
  1. Body Refined will make every effort to provide prompt support to all clients. If you are unable to keep a scheduled appointment, please give 24 hours advanced notice. A NO SHOW is when a client fails to keep a scheduled appointment.
  2. A NO SHOW will generate a $25 fee for the first instance and a $50 fee for every instance thereafter to the card on file.
  3. If you are a new client (first 4 weeks) and you do not show up for 2 consecutive appointments, and you do not call to cancel, you will be charged a $50 fee to the card on file.
  4. If you are an established client, your first no show will generate a $25 fee and the second no show will generate a $50 fee for every instance thereafter to the card on file.
  5. If you have a special circumstance regarding your missed appointment, please contact Body Refined via the patient portal or by telephone. We understand that there may be issues beyond your control and want to be understanding of exceptional circumstances.
  6. If you are delayed and cannot make an appointment on time, please call or send a message to advise of your situation and provide an estimated time of arrival. Any significant delay may require the appointment to be rescheduled.
  7. It is your responsibility to get on the schedule for your Weekly & Monthly Appointments.
FOOD LOGS
All clients must enter any, and all foods consumed into the food log to include a picture of the meal, snack or drink on the Body Refined preferred app. It is your responsibility to notify Body Refined if you encounter any technical problems while updating your food log.
If you do not update your food log, it can hinder your ability to achieve your goal(s). For the first day that you do not update your food log, you will charged a $25 fee and $5 for each subsequent day after within the current month. The sum of fees for the previous week will be auto charged to the card on-file every Monday.
If you are a new client (first 4 weeks), you are excluded from the prior mentioned fees as you learn and establish the habit of consistently logging. But if you do not update your food logs 3 consecutive days, you will be charged a $50 fee and $10 to the card on file for each day missed during your first 4 weeks.
PROGRESS PICTURES & WEIGH-IN/CHECK-IN
Every week on the date(s) specified, you must step on the wireless scale to record your weight (within 30 minutes of the scheduled wake-up time but before you eat or drink) and/or four (4) full body pictures to include front, back, left side and right side. Wearing only shorts, boxers or underwear and sports bra as needed. You must wear the same outfit in every picture.
If you do not provide your current weight & pictures on the specified dates, it can hinder Body Refined’s ability to help you achieve your goal(s). If you do not send the information on the date/time specified, you will receive a reminder for the first incident. The second incident, the card on file will be charged a $25 fee and the third incident, the card on file will be charged a $50 fee and every instance thereafter.
If you are a new client (first 4 weeks), you are excluded from the prior mentioned fees as you learn and establish the habit of consistently checking-in per the instructions given on that specific check-in day. But if you do not provide your current weight and/or pictures on the specified dates for 2 consecutive weight or picture check-ins, the card on file will be charged $50 for each instance (weight or pictures, individually) during your first 4 weeks.
MEDICAL TESTING (BODY COMPOSITION SCAN, BLOOD WORK/VITALS, MEDICAL CHECK-UP)
Prior to the start of the Lifestyle Transformation program, you must have a Body Composition Scan (DEXA, BOD POD or InBody), blood work/vitals and a Medical Check-Up/Physical dated within 3 months of becoming a Body Refined client.
Specific to the Lifestyle Transformation program, the medical testing must be completed every six months and thereafter.
Specific to the Maintenance Support program, these tests must be completed annually.
 If you do not provide the results of the testing prior to the start of the program or by the 6-month renewal, services will be put on hold for a maximum of 14 days. If the medical testing results are not received by the close of the 14 days, you may be terminated from the practice.
BODY MEASUREMENTS
Every month on the date specified, you must provide Body Refined with your body measurements. As with weight measurement, body measurements tell us about the composition of the measured changes.
You cannot perform the measurements yourself. You must have someone else do the measurements for you. They should follow the instructions in the form as described.
You must provide your body measurements at least 48 hours prior to your scheduled monthly review meeting. If you do not provide your current measurements on the specified date, it can hinder Body Refined’s ability to help you achieve your goal(s). Without these measurements, your appointment must be rescheduled, and it could possibly delay the next steps in your progression.
If we must reschedule the appointment, the card on file will be charged a $25 fee.
ACTIVITY MONITOR
You must have a Body Refined approved activity monitor w/ Heart Rate Monitoring & bluetooth/wireless scale. You must provide Body Refined with the login credentials to your activity monitor account to allow Body Refined to monitor your activity as needed.
If you do not wear (excluding time in the shower/bath) or keep your activity monitor charged (At least 75%) or it is not synced at least 3x’s per day, it can hinder Body Refined’s ability to help you achieve your goal(s). If you do not wear, charge or sync your activity monitor daily, you will receive a reminder for the first incident. The second incident the card on file will be charged a $25 fee and the third incident, the card on file will be billed a $50 fee and every instance thereafter.
CALENDAR ACCESS
You must have a google account and you must provide calendar access (Make Changes and Manage Sharing) to Body Refined.
FEES & PAYMENTS
Payment in full is due before services are rendered. Non-compliance fees are due in full before the end of the month or you may no longer receive services from Body Refined. I accept MASTERCARD, VISA, DISCOVER & AMERICAN EXPRESS cards; PayPal or Apple Pay. Body Refined also accepts ACH (Electronic check) or Wires. Body Refined DOES NOT accept cash.
If monies owed are past by 30 days or more, it will be transferred to a Collection Agency.
1847. Criminal Copyright Infringement – 17 U.S.C. 506(a) And 18 U.S.C. 2319
The principal criminal statute protecting copyrighted works is 17 U.S.C. § 506(a), which provides that [a]ny person who infringes a copyright willfully and for purposes of commercial advantage or private financial gain” shall be punished as provided in 18 U.S.C. § 2319. Section 2319 provides, in pertinent part, that a 5-year felony shall apply if the offense consists of the reproduction or distribution, during any 180-day period, of at least 10 copies or phonorecords, of 1 or more copyrighted works, with a retail value of more than $2,500.” 18 U.S.C. § 2319(b)(1).
The 1992 amendments to section 2319 have made it possible to pursue felony level sanctions for violations relating to all types of copyrighted works, including computer software and other works written, stored or transmitted in a digital format, if the other elements of the statute are satisfied. Felony penalties only attach to violations of a victim’s rights of reproduction or distribution in the quantity stated. A misdemeanor shall apply if the defendant does not meet the numerical and monetary thresholds, or if the defendant is involved in the infringement of the other rights bestowed upon the copyright holder, including the right to prepare derivative works, or the right to publicly perform a copyrighted work.
There are four essential elements to a charge of criminal copyright infringement. In order to sustain a conviction under section 506(a), the government must demonstrate: (1) that a valid copyright; (2) was infringed by the defendant; (3) willfully; and (4) for purposes of commercial advantage or private financial gain. Attempts to infringe are prohibited to the same extent as the completed act. Conspiracies to violate the Act can be prosecuted under 18 U.S.C. § 371. A minority of courts also require that the government prove the absence of a first sale, and refer to this as a fifth element of a section 506(a) offense. However, the majority position is that the absence of a first sale is an affirmative defense. Thus, the government does not need to allege it in the indictment or to present initial evidence to negate the defense. See this Manual at 1854.
UNDERSTANDING OF THE PROGRAM
The Lifestyle Transformation & Maintenance Support program is not a meal plan” or weight loss” program but a Lifestyle Transformation & Support program. With that, please know that Body Refined will provide the necessary direction and support to help you make the necessary changes in your life to improve your mental, emotional and physical well-being.
With that said, the guidance & counseling provided to you should not be sold, shared or adapted in any way as the services provided are paid for and customized for only you.
If you wish to cancel this agreement, you may cancel by mailing a written notice by certified mail or email, return receipt requested, to Body Refined. The notice must say that you do not wish to be bound by this contract and must be delivered via email or mailed before midnight of the third business day (business days include Saturday) after your receipt of a copy of this contract. The notice must be mailed to P.O. Box 1062, Beltsville, MD 20704-1062 or emailed to financedept@bodyrefinedinc.com. If you, the Buyer, cancels under this section, Body Refined shall refund any deposit, down payment, or payment of the Agreement excluding the consult fee.

Body Refined may suspend or terminate your right to continue services if you do not follow the program or violate the Agreement. You shall not be entitled to any refund, credit or abatement if such a breach of the Agreement occurs.
